1. License to Use

Unless otherwise stated, 52apps and/or its licensors own the intellectual property rights for all material on our applications and services. All intellectual property rights are reserved. You may view and/or use our applications for your personal use subject to the restrictions set in these terms and conditions.

2. Restrictions

You are specifically restricted from all of the following:

• Publishing any material from our services in any other media without prior permission.
• Selling, sublicensing, or otherwise commercialising any service material.
• Using our services in any way that is or may be damaging to our services.
• Using our services in any way that impacts user access to our services.
• Using our services contrary to applicable laws and regulations.
• Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to our services.
• Using our services to engage in any advertising or marketing without our explicit consent.

3. Use of Applications and Services

These terms apply to all applications, websites, application programming interfaces (APIs), extensions, downloadable software, and any related services we make available (collectively, the "Apps and Services"), whether free or paid and regardless of distribution channel. Your use of any of the Apps and Services constitutes acceptance of these terms and any additional terms presented at sign-up, in-app, or at the point of purchase.

• Some of our Apps and Services may require you to be at least 16 years old (or the age of majority in your jurisdiction, if higher). If you are under 18, you represent that you have parental or guardian consent.
• You are responsible for the devices, software, internet connection, and carrier charges required to use the Apps and Services, and for ensuring your device meets minimum requirements.
• You must only use the Apps and Services for lawful purposes and in accordance with these terms. Do not circumvent security or technical measures, rate limits, or access controls.
• We may suspend, restrict, or terminate access to any part of the Apps and Services if we reasonably believe there is a breach of these terms, risk to other users, or risk to our systems.
• We may introduce, change, or remove features at any time. Where changes are material, we will provide reasonable notice where practicable.

4. Purchases, Subscriptions, and Trials

We may offer paid features, in-app purchases, one-time purchases, and subscriptions within the Apps and Services. Pricing, features, and availability may vary by region and distribution channel. Unless stated otherwise, all fees and charges are non-refundable to the fullest extent permitted by law.

• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before renewal. You can manage or cancel subscriptions in your account settings or via the platform or store where you purchased.
• Trials: If a trial is offered, it will convert to a paid subscription at the end of the trial unless you cancel before the trial ends. We may determine your eligibility for trials and may modify or terminate a trial at any time.
• Taxes and pricing changes: Prices may change. If they do, we will give prior notice where required. Applicable taxes may be charged depending on your location.
• Third-party stores: If you make a purchase through a third-party platform or app store, that provider's payment and refund policies apply. We do not control and are not responsible for their policies or decisions.

5. Your Content

In these terms and conditions, "Your Content" means any audio, video, text, images, or other material you choose to display on or upload to the Apps and Services. By displaying Your Content, you grant 52apps a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable licence to use, reproduce, adapt, publish, translate, and distribute it in any and all media.

Your Content must be your own and must not infringe any third party's rights. 52apps reserves the right to remove any of Your Content from the Apps and Services at any time without notice.

6. Availability and Changes

The Apps and Services are evolving and may change over time. We may suspend, discontinue, or modify any part of the Apps and Services at any time, with or without notice. We may release features labelled as beta, preview, or experimental. Such features may be less stable and are provided without any commitments of support or continued availability.

7. Third-Party Services and App Stores

The Apps and Services may interoperate with or link to third-party websites, services, content, or platforms, including distribution platforms and app stores. We do not control and are not responsible for third-party services. Your use of third-party services may be subject to separate terms and privacy policies, which you should review. To the maximum extent permitted by law, we are not liable for any acts or omissions of third parties.

8. No Warranties

The Apps and Services are provided on an "as is" and "as available" basis, with all faults. To the fullest extent permitted by law, 52apps disclaims all warranties, representations, and conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Apps and Services will be uninterrupted, timely, secure, error-free, or free of harmful components, or that any defects will be corrected. Nothing in the Apps and Services constitutes advice of any kind, and you should not rely on it as such.

9. Limitation of Liability

To the maximum extent permitted by law, 52apps and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of the Apps and Services.

To the extent liability cannot be excluded, our aggregate liability to you for all claims relating to the Apps and Services will be limited to the amounts you paid (if any) to 52apps for the Apps and Services giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. If you are a consumer, your statutory rights are not affected.

10. Indemnification

You agree to defend, indemnify, and hold harmless 52apps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way related to: (a) your use of the Apps and Services; (b) Your Content; or (c) your breach of these terms or applicable law.

11. Severability

If any provision of these terms is found to be invalid or unenforceable under any applicable law, that provision will be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will remain in full force and effect.

12. Variation of Terms

52apps may revise these terms from time to time. Changes will be effective when posted on the Apps and Services (or otherwise communicated to you) with an updated "Last updated" date. Your continued use after the changes take effect constitutes acceptance of the revised terms.

13. Governing Law

These terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation are governed by the laws of England and Wales. If you are a consumer and reside in another country, you may benefit from mandatory provisions of the laws of that country. You and we agree that the courts of England shall have exclusive jurisdiction, except that consumers may bring claims in the courts of their country of residence.
